Real Estate – Buyer Broker Agreements

Important Changes in Buyer Broker Agreements

If you’ve been following the news, you’ve likely heard about the new rules for real estate agents regarding commissions and buyer agreements.

As of August 17th, 2024, a significant change will occur in how Realtors have conducted business for nearly 100 years. Traditionally, the compensation for buyer’s brokers was clearly published in the MLS (Multiple Listing Service). This is no longer the case.

The compensation details are now private, and seller’s agents must share this information individually for each listing, outside of the MLS.

Additionally, buyers must have a formal agreement with their agents before viewing any property, whether in person or virtually. This agreement will outline the maximum compensation the agent can receive in a transaction and specify who will pay that compensation.

Buyer Broker Agreement

Buyers Essential Have Four Options

1. Limit Property Showings:

Buyers can instruct their broker not to show them properties where the seller isn’t offering compensation to the buyer broker. This means any listings where the seller won’t pay the broker’s commission won’t be shown to the buyer.

This option may be common since buyers are not used to paying their agents, but it could limit the number of homes they see and result in fewer offers for sellers.

2. Pay the Broker Directly:

Buyers can agree to pay their broker directly on any property they purchase, regardless of whether the seller is offering compensation.

This option reduces the seller’s closing costs but is likely to be the least chosen. Buyers who choose this will factor the broker’s fee into their offer and negotiations.

3. Include Compensation in the Contract:

Buyers can ask their broker to include a clause in the sales contract that requires the seller to pay the broker’s commission if it’s not already offered.

This option keeps the traditional approach, where the seller pays the buyer broker’s fee.

4. Split the Compensation:

Buyers can agree to pay the difference between the maximum compensation agreed upon in the buyer broker agreement and whatever the seller offers.

This option shares the responsibility between the buyer and seller, ensuring the broker is fully compensated.

We’ve developed a new form to reflect the latest changes in real estate rules regarding commissions and buyer agreements. Please note that this is all very new to us, and we may revise the form in the future to better meet your needs as we adapt to these changes. 

Current Trends in Buyer Broker Compensation

What we’re seeing right now is that most sellers are still offering buyer broker compensation—about 99% are continuing this practice. However, there may be times when we encounter a seller who chooses not to offer compensation. Rest assured, as your agents, we’re prepared to work with you and ensure you get the best possible deal.

Our View on Offering Buyer Broker Compensation

In our view, while sellers are no longer required to offer compensation to buyer brokers, it’s in the seller’s best interest to do so. From our experience, offering this compensation typically leads to more showings, more offers, and ultimately, a higher net sales price for the seller.

With the recent changes, listing agents now need to negotiate this compensation, making it even more important to ensure the seller gets the best possible outcome. Based on our years of experience in the Florida Keys real estate market, we strongly believe that offering buyer broker compensation maximizes exposure and helps sellers achieve the highest net sales price.

While the new regulations have shifted how compensation is handled, we remain committed to guiding you through this evolving landscape. Offering compensation to buyer brokers continues to be a strategic move that benefits sellers by attracting more buyers and potentially achieving a higher sale price.

Yesterday, our office had the privilege of meeting with Kimberly Matthews, Sr. Director of Strategic Planning in Monroe County. She gave us a great presentation about the future of Rogo here in the Florida Keys.

Here are some takeaways from our meeting with her. We will also include some slides.

FloridaCommerce is responsible for the creation and updating of the FL Keys Evacuation Model. In 2013, they established a 10-year planning horizon ending in 2023. 

Data is currently being gathered for a new model, which will be revised by the Governor’s Advisory Council in January 2025, establishing a new 10-year planning horizon. 

Rogo

Monroe County will recommend their considerations to the state for the new plan, taking into account infrastructure, public facilities/services, environmental costs, financial liabilities to taxpayers, and property rights.

The general planning timeline to evacuate the county’s entire population is 24 hours.

As of June 2024, there are approximately 67 ROGOs left in the Upper Keys, 63 in the Lower Keys, and 9 in Big Pine/No Name.

There are 22 affordable rights left, but all have been spoken for. 

Administrative Relief includes 144 market and 300 Early Evacuation Affordable ROGOs left.

There are an estimated 2,220 lots left that could potentially be developed. Owners of these lots who do not receive allocations could file takings claims. The county’s potential takings liability is estimated at $1 billion.

The cost of defending property rights claims is borne countywide by taxpayers, who may see property tax increases. 

However, taking liability remains manageable by continuing the ROGO system. Managed slower growth is acceptable and should be expected.

Total Cost Breakdown of a Transferable Building Allocation

Well, you’re in luck because today we will cover the total cost of purchasing a Transferable Building Right (TBR) for the City of Marathon.

  • The average cost of a Transferable Building Allocation in Marathon, Florida, has been around $200,000. However, in the past few months, we’ve seen more Transferable Building Allocations come on the market. As a result, prices have fluctuated between $170,000 and $220,000

Additional Fees

  • Now, with TBRs in Marathon, there is a $40,000 transfer fee. This fee is set by the City of Marathon, so there are no discounts on it!

  • When you’re buying a TBR, you have to look closely at each one. Some transferable building allocations will indicate that the $40,000 transfer fee has already been paid. So, you could save some cash depending on the list price. However, some sellers just charge a higher list price, so there might not be any real savings.

Closing Costs

  • The second thing you need to understand is that most sellers require buyers to cover ALL closing costs, including commissions. You may see language in the description stating “buyer to pay all closing costs and seller to net $200,000.”

  • As always, commissions are negotiable. However, in Marathon, most real estate agents charge a 10 percent commission on TBRs. Not every agent charges this rate, so feel free to call us for more details. Since sellers typically request buyers to cover ALL closing costs and buyers have been complying, sellers have often agreed to the 10 percent commission.

Here is an estimate of the cost of a Transferable Building Allocation at a sale price of $200,000:

  • Contract sales price: $200,000.00
  • Application Fee: $600.00
  • Settlement Agent Fee: $2,000.00
  • Recording Fee: $300.00
  • Document Stamps: $1,400.00
  • City Transfer Fee: $40,000.00
  • Commission: $20,000.00

Total Estimate: $264,300.00

We’re in Spring 2024, and you’re curious if home prices in the Florida Keys are dropping. Well, I’m here to tell you that they are not. Each month, we analyze the numbers across the entire Florida Keys. You can check out our Florida Keys Home Pricing Report on our marketing page. Florida Keys Home Prices Holding Firm

Over the past year, overall home prices in the Florida Keys have remained stable, if not slightly higher than previous years. They are stable, but they’re still quite high! Frankly, in my 15 years of experience in real estate here in the Florida Keys, I’ve only seen prices go up!

Now, I’ll share that we’re experiencing more inventory. During the crazy real estate run, we were down to just 1,300 listed properties for sale. But now, for the first time in years, we’ve broken over 2,000 homes for sale.

We’ve been diligently tracking the number of listings week by week for some time. In March, we observed our highest number of listings, reaching 2,177 homes for sale. Our high season typically spans from January to April, peaking in March, so that seems to be right on track. I suppose only time will tell if that will be our high inventory level for the year.

I’ve started to notice a decrease in prices in the condo market. I believe the condo market has been hit pretty hard with all the new regulations and requirements. If you’re in the market for a condo and you’re not familiar with all the new laws and regulations, you should definitely check out our blog for more information.

Insurance in the Florida Keys has seen a significant increase in recent years. FEMA’s Risk Rating 2.0 initiative, while a bit chaotic, has notably impacted flood insurance costs. Additionally, Citizens, our main wind insurance carrier, has mandated that if you have wind insurance, you must also have flood insurance, further driving up prices. These insurance factors are starting to influence pricing more here in the Florida Keys. Whether they will pull prices down remains to be seen. Time will tell.

No Dip in Sight: Florida Keys Real Estate Home Prices

So to answer your question, are home prices dropping in the Florida Keys? The short answer is no, not yet. While other places around Florida may be experiencing drops, here in the Keys, it hasn’t started. Be sure to check back often and read our posts, or simply sign up for our email updates. Trust me, we’re closely watching the market, and you’ll know as soon as we do when the prices start coming down!

Plus, since it’s one of the few places on the route to Key West with just two lanes, drivers tend to speed, making it even trickier to get around on foot. A car is definitely your best bet for getting around safely and conveniently.

In Marathon, there are only a handful of spots where walking or biking is safe. These include the Sombrero Beach area, the area behind the airport, Coco Plum, and all of Key Colony Beach.

There are plenty of small shopping plazas to explore in Marathon, but you’ll need a car to reach them.

A car is definitely your best bet for getting around Marathon, Florida.

In the heart of the Florida Keys lies the city of Marathon, a laid-back island town with plenty of beauty. But for those craving a taste of the vibrant energy and eclectic culture of Key West, the question arises: How far is it from Marathon to Key West?

The journey to Key West typically takes an hour to reach the top of Key West. In season, which runs from January to April, it could take an hour and a half. Now, if you are heading to Duval Street, add another 20 minutes or so from the time you enter Key West. Duval Street is pretty deep into Key West, and of course, there is always traffic there.

On the way down to Key West, there always seems to be that one car driving slow. With limited passing areas, you’re often stuck behind slow cars for miles. The bridge near Bahia Honda State Park is one of your chances to pass, as the road opens to two lanes. But remember, don’t speed after getting off that bridge. There are always cops waiting on either end, so make sure you slow down when you’re going down the hill.

Although the trip from Marathon to Key West can take some time and your road rage might kick in a bit, the views are pretty spectacular.

A few excellent stops on the way from Marathon to Key West include Boondocks, the jumping bridge, and Baby’s Coffee. If you’re not in a hurry, these spots offer a perfect opportunity to take a break during your journey.

Recently, Monroe County convened a workshop in Key Largo to discuss the future of ROGO. During this session, the county revealed new research findings indicating a significant revision in the number of buildable lots within the Florida Keys. Previously estimated at around 8,000, meticulous research and application of zoning laws now suggest there are approximately 3,000 viable building lots left in the Keys.

Exploring the Beaches of Marathon Florida

Ready to visit Marathon, Florida, and curious to know if there are beaches here? Well, you’re in luck because there are actually two beaches here in Marathon.

Now, these beaches aren’t huge, and they don’t stretch on for miles and miles, but the sand is nice and soft, and the water is great! The two beaches in Marathon, Florida, are Sombrero Beach and Coco Plum Beach.

One thing to remember about the beaches in Marathon is that we have a reef a few miles back, so we don’t get huge waves here. Which, personally, I like a lot because you can actually swim in the water and not worry about getting towed under or knocked down by a wave.

Sombrero Beach

Sombrero Beach in Marathon Florida 

Sombrero Beach in Marathon, Florida, in my opinion, is one of the nicest in all of the Florida Keys. Sombrero beach has everything you need for a great day at the beach. There are shaded picnic tables, grills, showers, and bathrooms. The area also has a playground for the kids and beach volleyball. Sombrero beach also has a little grass area!

Sombrero beach can get busy at times. You will find a lot of families and children at this beach. If you go early in the morning, typically there are not a lot of people there. Plus, they rake the beach in the morning, and I just love when the sand is newly raked!

Just recently, the City of Marathon started to charge visitors for parking at the beach. It’s five dollars for the first two hours and then two dollars for each hour after. Now, if you’re a resident of Marathon, parking is free.

Coco Plum Beach

Coco Plum Beach in Marathon Florida

Coco Plum Beach is located in the Coco Plum neighborhood of Marathon. Now, this beach is a lot different from Sombrero Beach. Coco Plum beach doesn’t have as many amenities as Sombrero Beach; in fact, the only things they have are bathrooms, and we just got those a few years ago.

Coco Plum beach is also a lot more “shelly,” and the sand at times isn’t the best to walk on.

Coco Plum beach is more known as the dog beach in town. A lot of people bring their furry friends there, which is fine by me!

During low tide at Coco Plum beach, you can walk out super far into the ocean. There are tiny shells all over too, which makes it fun. Additionally, Coco Plum beach has a decent amount of trees along the beach, so there are kind of like little hidden areas to explore.

Overall, Coco Plum beach is much quieter than Sombrero beach. When we go there, there are only a few handfuls of people there.
